PRACTICE AREAS

CRIMINAL LAW

Our criminal practice is one of the core practice areas of the firm, and involves trial and appellate representation in both Pennsylvania and Federal Courts.

The Pennsylvania practice is state-wide, and thousands of cases have been handled in more than 25 Pennsylvania Counties over the years.  The firm's criminal practice involves the start-to-finish representation of citizens and businesses charged pursuant to the Pennsylvania Crimes Code, the Federal Criminal Code, and various administrative statutes and regulations.

Major areas of this practice include cases involving drug violations, homicide, theft, firearms, detainers, DUI and major driving offenses, probation and parole matters, "organized crime"/RICO, white-collar and financial crimes, forgery, fraud, counterfeiting, computer-related offenses, and Attorney General investigations.  In addition, the firm handles collateral consequences of criminal matters such as expungements, detainers, restoration of firearms rights and immigration/deportation defense.

Attorney Marc Daffner has been certified by the Pennsylvania Supreme Court to provide representation in death penalty cases pursuant to Pa.R.Crim.P. 801.

FIREARMS LAW

AND RIGHTS

Because it doesn't say "just kidding" after the Second Amendment.

Have you been denied a firearms permit or prevented from purchasing a firearm due to an old criminal conviction or a medical reason which has been resolved?  Do you wish to put your firearms into a trust to avoid probate and ensure a smooth transfer to your heirs?  Have you been criminally charged based on an unintentional misrepresentation on a purchase document?  We're here to help.

While the Second Amendment gives all citizens the "right to keep and bear arms," this right is limited by numerous state and federal statutes regulating the types of firearms you may have, the manner in which you may keep them, and whether or not you're even permitted to have them in your possession at all.  Navigating these waters can be tricky, despite what you may have heard about firearms laws.

We provide representation and assistance with issues involving firearms, including, but not limited to:

Licensing and Purchasing Issues

License Denial Appeals

NFA-Compliant Firearms Trusts

Expungement of Criminal and Mental Health Records

Reinstatement of Civil Rights/Firearms Privileges

FFL Business Representation

FFL / Sales License Revocation Defense

BUSINESS AND
COMMERCIAL REPRESENTATION

If it was fun, it wouldn't be called "work," would it?

While "the business of America is business," sometimes the business of business comes under attack.

The Commercial practice is centered on creditors’ rights, and debt litigation, including commercial collection matters, consumer protection issues, credit/real estate defaults, foreclosure, and judgment execution/recovery.  The commercial practice involves both the prosecution and defense of commercial and loan contract claims including those of major nationwide credit providers. All aspects of foreclosure and tax sales, including reassessment of damages and sheriff sales are included in this practice.  Also included in this area are issues involving the FDCPA, PAFCEUA, TILA, FCRA, and the SCRA, among other applicable credit-related regulations.

Ancillary to this, general corporate law is also practiced, and involves matters such as negotiation of contracts, corporate formation, business sales, business litigation, employment-related immigration issues, risk and exposure assessment, government relations, and associated matters. The practice further involves corporate officer and director liability, regulatory compliance, shareholder litigation, and criminal liability of corporate entities.

Due to our hands-on, personal approach to corporate legal issues, we have a proven history of attracting, retaining and developing clients by providing effective and innovative solutions to their corporate legal needs. Whether you are a sole proprietorship or a major corporation, our firm is here to assist you.
