CRIMINAL LAW

Our criminal practice is the core practice area of the firm, and involves trial and appellate representation in both Pennsylvania and Federal Courts. 

 

The Pennsylvania practice is state-wide, and thousands of cases have been handled in more than 20 Pennsylvania Counties over the years.  The firm's criminal practice involves the start-to-finish representation of citizens and businesses charged pursuant to the Pennsylvania Crimes Code, the Federal Criminal Code, and various administrative statutes and regulations. 

 

Major areas of this practice include cases involving drug violations, homicide, theft, firearms, detainers, DUI and major driving offenses, probation and parole matters, "organized crime"/RICO, white-collar and financial crimes, forgery, fraud, counterfeiting, computer-related offenses, and Attorney General investigations.  In addition, the firm handles collateral consequences of criminal matters such as expungements, detainers, restoration of firearms rights and immigration/deportation defense.

Attorney Marc Daffner has been certified by the Pennsylvania Supreme Court to provide representation in death penalty cases pursuant to Pa.R.Crim.P. 801.

TAX LAW AND REPRESENTATION

The Internal Revenue Service has the right to collect money due and owing to the United States Treasury by virtue of the provisions of the Internal Revenue Code.  Indeed, taxation has been called "the price that we pay to live in a free society," and it is the responsibility of all citizens to adhere to their obligations.

 

In the real world, however, it is often difficult for taxpayers to meet their obligations in a timely fashion, resulting in late or unfiled returns, tax collection issues, and even allegations of fraud and evasion.  To make matters worse, many taxpayers are accused of owing incorrect amounts, they are subject to illegal liens and levies, and they may be penalized for decisions which they make based upon faulty advice from IRS employees themselves!

 

When you are given notice that you are subject to tax-based proceedings, you may not know where to turn.  The government has the right to file levies and liens against your bank accounts and properties for alleged tax debts, which not only make it difficult for you to do anything financially, but which may result in actual seizure of your property.  Many people simply throw their hands up and ignore the problem, not knowing what to do - and that just makes the issues get worse.

 

That's where we come in.  Our office will commence a full-scale investigation into whether you actually owe the amount which the government claims, and whether you have been afforded the procedural due process rights to which you are entitled as a United States citizen.  We then make an assessment as to the most appropriate route to proceed in dealing with the IRS on your behalf, and act as your representatives during the entire process, with the goals of both protecting your rights and reducing your tax liability.
